Building safely under increasing scrutiny
Construction and civil contracting is one of Australia’s most heavily regulated, and most hazardous, industries. Six industries account for 80% of all work-related traumatic injury fatalities and 61% of serious workers’ compensation claims nationally, and construction is consistently one of them, recording 37 fatalities in 2024 alone and 12% of all serious claims. Falls from height, being struck by mobile plant and moving objects, and body stressing remain the persistent, everyday risks on every site, while psychosocial harm, driven by long hours, job insecurity, bullying and isolation, is now recognised as a regulated WHS hazard in its own right.
At the same time, the regulatory bar is rising. Codes of Practice are shifting from guidance to legally enforceable minimum standards in some jurisdictions, high-risk construction work definitions are being harmonised nationally, psychosocial hazard duties now sit alongside physical safety duties, and principal contractors and PCBUs face growing scrutiny over how they manage multi-tier subcontractor chains, SWMS quality, and worker wellbeing. What the law requires of your business
Construction and civil contracting organisations operate under the model Work Health and Safety (WHS) Act and Regulations (or jurisdiction-specific equivalents in Victoria and WA), with additional construction-specific obligations layered on top. Principal contractor and PCBU duties — Every construction project must have a single principal contractor responsible for the WHS management plan, site-wide coordination and consultation across every business and undertaking on site. Where multiple subcontractors, designers and suppliers share duties concurrently, each must consult, cooperate and coordinate, a requirement that becomes harder to evidence as project complexity and subcontractor chains grow.
High-risk construction work (HRCW) and SWMS — Eighteen categories of construction work, including work involving a risk of falling more than two metres, demolition, asbestos disturbance, excavation requiring temporary support, and work near live traffic corridors or mobile plant, require a Safe Work Method Statement before work begins. SWMS are under increasing regulatory scrutiny, with a clear push toward shorter, task-specific, genuinely usable documents rather than generic paperwork, and toward digital systems that keep them current as site conditions change.
Codes of Practice — The model Code of Practice: Construction Work sets out how principal contractors and other PCBUs are expected to meet their WHS duties on site. In several jurisdictions, approved Codes of Practice are moving from “guidance” status to legally enforceable minimum standards, meaning a documented, defensible reason is now needed for any departure.
Psychosocial hazards — Nearly every Australian jurisdiction now requires PCBUs to proactively identify, assess and control psychosocial hazards, including bullying, fatigue, excessive job demands, low job control and workplace isolation, with the same rigour applied to physical hazards. This is a live enforcement area, with regulators issuing improvement and prohibition notices, and is particularly acute in construction, where male construction workers face a suicide rate significantly higher than other employed men, concentrated heavily among younger tradies and apprentices.
Officer due diligence and industrial manslaughter — Company directors and officers carry a personal due diligence duty to ensure their organisation complies with its WHS obligations. Where a serious failure in managing physical or psychosocial risk contributes to a death, industrial manslaughter laws now apply in most Australian jurisdictions, carrying significant penalties for both individuals and corporations.
